Theatres and Theatre Liability Insurance - UK
Below we have outlined the various covers available and answered some of
those questions we are asked every day.
This policy
is made up of various sections and you are able to choose the relevant covers
you may require. Although you can choose any number of sections
it is not possible to cover Employers Liability without Public Liability.
Here you can cover all of your Props, set, costumes,
instruments and technical equipment. In addition your Office Contents, Laptops
and Artistes
Property can be included. The standard policy would only cover your equipment
in the UK however you can either extend this as and when you tour abroad
and pay the small additional premium or extend to EC or Worldwide on an annual
basis. Performers policy has the benefit of a low £100 policy excess
and like most other policies does exclude losses from unattended vehicles.
This section has a set £10,000,000
limit of indemnity and covers your legal liability to your employees. This
is a legal requirement
without it you could be breaking the law. There seems to be a common misunderstanding
with who is and who is not an Employee. When we are asked to provide quotations
we are constantly told “we do not need this cover as our actors/crew
are freelance or volunteers” or “we do not pay them”, well
as soon as they start work you are breaking the law!! Do not confuse insurance
with the inland revenue, just because you do not pay someone’s income
tax does not mean they are not employees if they are under your control you
are legally responsible for them.
Here you can arrange cover to protect you from claims
made against you by third parties for property damage or bodily injury. You
have a
choice of limits available of £1,000,000 £2,000,000 and £5,000,000.
Although in most instances £1,000,000 is deemed adequate most local authorities
and venues now require £2,000,000 or £5,000,000. Again many of you
seem to believe that you do not require Public Liability insurance as the venue
already have it? Yes the venue will have cover so in the event that they are
held responsible their insurance will indemnify them, but if you are negligent
who will indemnify you. We have had many incidents where the venue have sued
the visiting company for example a stage was damaged where set was dragged across
it, this would have cost the company over £2,000 thankfully they were insured.
: Standard £500 cash limit can be increased if required
up to a maximum of £2,000, in addition to covering the actual loss/theft
of cash, assault benefits are included.
This differs from Employers Liability as insurers will
pay a chosen lump sum or weekly amount whether you are negligent or not.
Cover is
on a named person basis, it only covers accidents whilst working it is not 24
hour cover. If 24 hour cover is required then a separate bespoke policy can be
arranged.
As it says, if you own your own premises we are able
to arrange cover for you. Cover is available with or without subsidence
cover.
Either loss of gross profit, revenue or additional cost
of working are available following damage to your premises, for venues and most
office risks this is a must.
As a sign of the times Terrorism is now excluded from insurance. You have
the option of buying additional terrorism insurance more often than not at
the minimum
premium of £63.00.
There are many other forms of insurance available including Trustees Indemnity,
Cancellation & Non Appearance, Personal Accident and Sickness, Directors & Officers
etc etc. At Performers we feel we are able to cover the needs of most, but like
most we do limit ourselves to our core business so there will be occasions where
we have to say no “fire jugglers please do not
call”.
